KITSUMACHI TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of kitsumachi.com and your purchase of products from KitsuMachi, LLC ("KitsuMachi," "we," "us," or "our").
By accessing our website, placing an order, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use our website or purchase our products.
1. ONLINE STORE
KitsuMachi operates an online retail business offering apparel, accessories, artwork, merchandise, and other products.
You may use our website and products only for lawful purposes. You may not use the website in a manner that violates applicable law, infringes another person's rights, interferes with operation of the website, introduces malicious code, attempts unauthorized access, or otherwise misuses our services.
You represent that you are legally capable of entering into a binding transaction or are using the website with the involvement and permission of a parent or legal guardian where required.
2. PRODUCTS AND AVAILABILITY
We make reasonable efforts to accurately display and describe our products. However, colors and other visual characteristics may appear differently depending on your screen, device, settings, and manufacturing process.
Many KitsuMachi products are made to order using third-party production and fulfillment providers. Minor variations in print placement, color, dimensions, or appearance that are normal to the applicable manufacturing process may occur.
Product availability, designs, sizes, colors, specifications, prices, and other offerings may be changed or discontinued without notice.
We reserve the right to limit quantities, refuse or cancel orders as permitted by law, correct errors, and discontinue products.
3. PRICES AND PAYMENT
Prices are displayed in the currency indicated at checkout and may change without notice.
Applicable taxes, shipping charges, and other charges will be shown at checkout when applicable.
You agree to provide current, complete, and accurate billing, payment, shipping, and contact information. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges associated with your order.
An order confirmation does not necessarily mean that an order has entered production or that we have accepted an order that we are legally entitled to reject or cancel.
If we cancel an order after payment has been successfully collected and no amount is otherwise properly owed, the applicable amount will be refunded.
4. MADE-TO-ORDER PRODUCTS
Many KitsuMachi products are manufactured specifically for the customer after an order is placed. Because production may begin shortly after checkout, changes and cancellations cannot be guaranteed once an order has been submitted.
Returns, refunds, replacements, exchanges, cancellations, damaged items, incorrect products, and similar matters are governed by our Return and Refund Policy, which is incorporated into these Terms by reference.
5. SHIPPING AND DELIVERY
Shipping and delivery estimates are estimates rather than guaranteed delivery dates unless expressly stated otherwise.
Production and delivery may be affected by carriers, fulfillment providers, weather, holidays, customs, supply disruptions, incorrect addresses, and circumstances outside KitsuMachi's reasonable control.
Customers are responsible for providing an accurate and complete delivery address.
Additional terms concerning fulfillment, delivery, lost packages, international shipments, and related matters may be provided in our Shipping Policy, which is incorporated into these Terms by reference.
6. INTELLECTUAL PROPERTY
The KitsuMachi name, branding, logos, characters, illustrations, artwork, designs, graphics, product designs, written content, photographs, website content, and other creative materials displayed through our services may be owned by KitsuMachi, licensed to KitsuMachi, or otherwise used with authorization.
Except as permitted by applicable law or with prior written authorization from the applicable rights holder, you may not reproduce, copy, distribute, sell, commercially exploit, modify, publish, create unauthorized merchandise from, or otherwise use KitsuMachi content or protected creative materials for commercial purposes.
Purchasing a KitsuMachi product gives you ownership of the physical product purchased. It does not transfer intellectual-property ownership or grant a license to commercially reproduce the artwork or designs appearing on that product.
Nothing in these Terms transfers ownership of intellectual property belonging to KitsuMachi, its licensors, artists, contractors, or other rights holders.
7. USER CONTENT AND COMMUNICATIONS
If you voluntarily submit reviews, photographs, comments, feedback, suggestions, or other content to KitsuMachi, you represent that you have the right to submit that content and that doing so does not violate another person's rights.
You retain ownership of content you own. To the extent necessary for us to display, reproduce, moderate, or use content that you intentionally submit for publication through our services, you grant KitsuMachi a non-exclusive, worldwide, royalty-free license to do so for operating, promoting, and improving KitsuMachi and its services.
This provision does not give KitsuMachi ownership of your private communications with customer support.
8. THIRD-PARTY SERVICES
Our website and operations may rely on third parties, including Shopify, payment processors, production partners, fulfillment providers, shipping carriers, analytics providers, and other service providers.
Certain third-party services may be subject to their own terms and privacy practices.
Links to third-party websites or services do not necessarily constitute an endorsement by KitsuMachi. We are not responsible for third-party websites or services to the extent permitted by applicable law.
9. PROHIBITED CONDUCT
You may not use our website or services to:
• Violate applicable law or another person's legal rights;
• Commit or facilitate fraud;
• Submit false or misleading information;
• Infringe copyrights, trademarks, privacy rights, or other rights;
• Introduce malware or malicious code;
• Attempt unauthorized access to our systems or accounts;
• Scrape, harvest, or collect information through unauthorized automated means;
• Interfere with the security or operation of our website;
• Circumvent purchasing restrictions or security measures; or
• Abuse our refund, payment, promotion, or customer-service processes.
We may restrict or terminate access to our services when reasonably necessary to address prohibited conduct, subject to applicable law.
10. PROMOTIONS AND DISCOUNTS
Promotional codes, discounts, giveaways, and special offers may be subject to additional conditions disclosed with the promotion.
Unless otherwise stated, promotions have no cash value, may not be combined, and may be modified or discontinued as permitted by law. We may reject fraudulent, unauthorized, or improperly obtained promotional benefits.
11. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, our website, services, and products are provided subject to any warranties and consumer rights that cannot legally be excluded.

We do not warrant that the website will always be uninterrupted, error-free, or free from every harmful component.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, KitsuMachi, LLC and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website, services, or products.
To the fullest extent permitted by applicable law, KitsuMachi's aggregate liability arising from a particular purchase will not exceed the amount actually paid to KitsuMachi for the product or order giving rise to the claim.
These limitations do not apply where liability cannot legally be excluded or limited.
13. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless KitsuMachi, LLC and its owners, officers, employees, contractors, and agents from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful misuse of our services, your violation of these Terms, or your infringement of another person's rights.
This provision does not require you to indemnify KitsuMachi for KitsuMachi's own unlawful conduct where such an obligation would be prohibited by law.
14. PRIVACY
Our collection and use of personal information is described in our Privacy Policy. By using our services, you acknowledge that your information will be handled as described in that policy and as otherwise permitted or required by applicable law.
15. ERRORS AND CORRECTIONS
Product descriptions, prices, promotions, availability, shipping information, or other website content may occasionally contain errors.
We may correct errors and update information as permitted by law. If a material error affects an order you already placed, we will take appropriate steps consistent with applicable law, which may include contacting you or canceling and refunding the affected order.
16. GOVERNING LAW
These Terms are governed by the laws of the State of Tennessee and applicable federal law, without regard to conflict-of-law principles, except to the extent another jurisdiction's laws must apply and cannot lawfully be waived.
Nothing in these Terms deprives a consumer of mandatory protections or remedies provided by applicable law.
17. SEVERABILITY
If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted or severed as appropriate, and the remaining provisions will remain in effect.
18. NO WAIVER
A failure by KitsuMachi to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.
19. CHANGES TO THESE TERMS
We may update these Terms from time to time. The current version will be posted on our website with an updated "Last Updated" date.
Changes will apply prospectively unless otherwise permitted by applicable law. Material changes will be communicated when required by law.
